Terms and Conditions - Tourist Rental

Article 1 - Purpose

This contract concerns the rental of the Gîte (name, address of the Gîte). It is either a Gîte or a guest room.

Article 2 - Duration of the Stay

The tenant who signs this contract for a specified duration cannot claim any right to remain in the premises beyond the agreed period.

Article 3 - Conclusion of the Contract

The reservation becomes effective when the tenant has sent the deposit specified on the front page along with a signed copy of the contract before the stated date. A second copy must be kept by the tenant.

The rental concluded between the parties under this contract cannot, under any circumstances, benefit even partially any third parties, whether individuals or organizations, unless there is written consent from the owner.

Any violation of this clause could lead to immediate termination of the rental at the tenant’s expense, with the rental proceeds remaining definitively with the owner.

Article 4 - Cancellation by the Tenant

Any cancellation must be notified to the owner with acknowledgment of receipt.

a) Cancellation before arrival:
The deposit remains with the owner. The owner may ask for the balance of the rental price if the cancellation occurs less than 30 days before the planned arrival date.
If the tenant does not show up within 24 hours of the agreed arrival date, this contract becomes null, and the owner may re-rent the Gîte. The deposit also remains with the owner, who can ask for the balance of the rental.

b) If the stay is shortened, the rental price remains with the owner. No refund will be made.

Article 5 - Cancellation by the Owner

The owner will refund the tenant all sums paid in advance.

Article 6 - Arrival

The tenant must arrive on the day and within the time slot indicated in the contract. In case of a late or delayed arrival, the tenant must inform the owner.

Article 7 - Payment of the Balance

The balance of the rental price is due no later than the entry into the premises.

Article 8 - Inventory

An inventory is made jointly and signed by both the tenant and the owner or the owner’s representative upon arrival and departure from the Gîte. This inventory constitutes the sole reference in case of a dispute regarding the state of the premises.

The cleanliness of the Gîte upon the tenant's arrival will be recorded in the inventory. Normal cleaning of the premises is the responsibility of the owner. In case of abnormal use or exceptional dirt, the cleaning cost will be charged to the tenant.

Article 9 - Security Deposit

Upon arrival, the tenant is required to provide a security deposit, the amount of which is specified on the front page of this contract. After the exit inventory is completed, the deposit is returned, minus any costs for restoring the premises if any damage is found.

If the tenant departs early (before the time mentioned in the contract), preventing the inventory from being carried out on the same day, the security deposit will be returned by the owner within a period not exceeding one month.

Article 10 - Use of the Premises

The tenant must ensure peaceful enjoyment of the rental and use it in accordance with its intended purpose.

Article 11 - Capacity

This contract is established for a maximum capacity of people. If the number of tenants exceeds the accommodation capacity, the owner may refuse the additional persons. Any modification or breach of the contract will be considered initiated by the client.

Article 12 - Pets

This contract specifies whether the tenant may or may not stay with a pet. If this clause is violated by the tenant, the owner may refuse the stay. No refund will be made in this case.

Article 13 - Insurance

The tenant is responsible for any damage caused by their actions. They must be insured and check whether their home insurance contract covers holiday rentals. If not, they should inquire with their insurer.

The owner may request proof of insurance or, failing that, a sworn statement.

Article 14 - Liability

The owner disclaims any responsibility for theft, loss, or damage to the tenant’s personal property during the rental period.

The owner is also not responsible for accidents or incidents occurring during the rental period, unless due to intentional fault or gross negligence on their part.

Article 15 - Payment of Utilities

Water and electricity charges are included in the rental price for normal use. In case of abnormal usage, the tenant may be charged for the excess.

Article 16 - Modifications to the Terms and Conditions

The owner reserves the right to modify these Terms and Conditions at any time. Changes will take effect as soon as they are published on the "Gîte de l’Ours Blanc" website.

Article 17 - Disputes

Any claims related to the rental will be handled by the competent court.
